Kolo Toure's positive drugs test leaves Manchester City captain facing fight to prove his innocence
Kolo Touré could be banned for two years from football even if the defender, yesterday suspended indefinitely by Manchester City, can prove he inadvertently tested positive for a “specified substance”.

City and the Football Association both confirmed last night that an ‘A’ sample provided by Touré had proved positive. The player can now opt to have his ‘B’ sample, taken in the same drugs test, analysed in a bid to prove his innocence.
“He has been suspended from participating in all first team and non-first team matches pending the outcome of the legal process,” read a statement on City’s website.
The FA stated “that a player has been provisionally suspended from playing pending investigation, having tested positive for the use of a prohibited substance.” It is the first positive test under the FA’s auspices since an unnamed player was banned after testing positive for cocaine in January last year.
City were informed of the results of the test late on Wednesday afternoon and duly withdrew the player from Roberto Mancini’s squad for the rearranged FA Cup fifth-round tie with Aston Villa. The failed test automatically triggered the suspension, with City left with no option but to exclude him from their plans until the conclusion of proceedings.
How long Touré is banned for, should he be found guilty, will depend on the substance involved, the explanation for how it was in his body and any mitigating circumstances.
According to the code of the World Anti-Doping Agency, “specified substances” are those that are “more susceptible to a credible, non-doping explanation.” Those substances on the list can be used to enhance performance but can also be found in legitimate therapies, such as cold cures and dietary supplements. Most common recreational drugs would not fall into the same category.
Even if Touré can prove to the FA that he only ingested a prohibited substance unknowingly, though, his punishment according to Wada could still be as draconian as a two-year ban.
The code states: “If the athlete can prove that he or she did not intend to enhance performance by using them to the satisfaction of the results management authority, the sanction under the World Anti-Doping code can go from a warning to a two-year ban.” The most recent precedent for cases of this type is the former Sheffield United goalkeeper Paddy Kenny, now with QPR, who was banned for nine months in September 2009 after testing positive for ephedrine, a prohibited substance found in cold remedies.
The FA chose not to punish Kenny to the full extent of its powers after admitting that he had not deliberately sought to enhance performance when taking an over-the-counter cold remedy without consulting United’s medical team.
The Hamilton midfielder Simon Mensing was banned for just a month after testing positive for another specified substance, methylhexaneamine, in December. The Englishman explained that he had taken a contaminated dietary supplement and provided credible evidence to support his case. The Scottish Football Association took that information into account when sentencing him to a rare short ban.
UK Anti-Doping warned athletes last November to be vigilant about the possible presence of banned substances in dietary supplements that are available on the high street.
Though neither Manchester City nor the FA were last night prepared to estimate a timescale for the case, it is likely that the club will be without Touré for far longer than the five games Mensing missed north of the border while the £14 million defender’s case is worked out. It is unlikely that the Ivorian will play again this season.
That will come as a major blow to Mancini, who has been at pains to point out recently how stretched his squad is with City attempting to challenge for both the FA Cup and the Europa League as well as securing a top-four berth in the Premier League.

The owl, which served as mascot for Atlético Junior, died in a local veterinary clinic in Barranquilla after veterinarian Camilo Tapia was unable to save the bird that was attacked by Moreno on Sunday.
Play during the Dimayor [the Colombian league] game was stopped after the bird was first struck by the ball near the Pereira penalty area prompting the referee to halt the game.
As the referee and players discussed what to do Moreno - apparently impatient over the delay with his team losing 2-1 - was seen to kick the bird towards the touch-line with his left foot before Atlético Junior fans chanted "murderer" at the Panamanian player.
Ramon Jesurum, president of Dimayor, said on Monday that "the player should be severely punished for this painful, horrible act of intolerance," before adding that the case would go before their disciplinary committee.
Menawhile Humberto Mendoza, the director of the agency that oversees environmental issues in Barranquilla, has said he will investigate possible sanctions against Moreno.

Scottish Football Association chief executive Stewart Regan was ''deeply embarrassed'' by the angry confrontations during and after Celtic's 1-0 Scottish Cup win over Rangers, which he claimed cast the game in a ''poor light''.
But Jefferies believes the encounter - which saw three Rangers players sent off and Celtic boss Neil Lennon being pulled apart from Rangers assistant Ally McCoist - can only increase Scottish football's broadcasting revenue potential.
Jefferies said: ''It was tasty, wasn't it? In terms of the application side of things, obviously a bit spilled over from the game the previous week.
''It just sparked off. It was a very tense situation and probably (Scottish Premier League chief executive) Neil Doncaster will be the one who will be happy because it was good telly viewing at times.
''Maybe not the football, but certainly the passion and all that. That's what they're saying TV wants.''
Jefferies categorically dismissed claims that the unrest was a disaster for the Scottish game.
He said: ''How is it a disaster? It will show around the world how much it means when Celtic and Rangers play.
''That derby is known the world over as one of the most competitive there is. Yesterday will highlight it.
''I think they're making it more out of order than it actually was.''
Jefferies downplayed the post-match rumpus between Lennon and future Rangers manager McCoist, who had almost clashed in the first half as the Celtic manager remonstrated with El-Hadji Diouf, who was sent off after the final whistle.
''It was run of the mill stuff,'' the former Kilmarnock manager said.
''We've all been there and done it. It's a little taster for the future.''

Fashion Week just wrapped up in New York City, and while the Fall clothes we saw paraded down runways won’t land in stores for months, we can celebrate all the amazing looks we saw this week by wearing items we already have in our closet in new and different ways. Taking cues from the biggest and best designers, here are seven ways you can wear the hottest fall trends to emerge from Fashion Week!
1. Lovely Layers at Narciso Rodriguez
Narciso Rodriguez piled on the glamour this week by sending completely covered models down the runway. We saw coats layered over dresses, long coats on top of pants, and dresses layered over boots. Tights are the one of the easiest ways to wear the layered look right now. Layer tights under dresses and skirts (black tights looks chicest). Throw on a dress and trench coat over tights while the weather is still chilly. When the thermostat rises, lose the coat and stockings. To get the layered look, you don’t need to buy anything new—just recycle what you already have in your closet, choosing brighter colors as the weather warms up.
2. Pretty Pleats at Vera Wang
We can always count on Vera Wang to show us women how to make ourselves look and feel as beautiful as possible, and this season she did it with pleated chiffon dresses that make us want to run out and throw a tea party ASAP! Take pleats to the street by looking for light, airy, and even sheer fabrics that achieve a breezy effect to imitate the gauzy pleats shown at Vera Wang. To avoid looking like a schoolgirl, stay away from above-the-knee skirts and instead go for pleated dresses and tops with pleated accents. To avoid getting burned out on this trend before spring arrives, start wearing pieces with small amounts of pleats now. For example, look for pleated waistbands, angled pleats, and tiered pleats instead of allover pleats.
Try Shopbop, who has a great See by Chloe pleated dress ($730, above), indie brand EmersonMade, and anything Halston Heritage. Give pleated items a tough edge by pairing them with fur or leather, as seen at Vera Wang.
3. Chic Ponchos and Cozy Fur at Alexander Wang and Joseph Altuzarra
This week, Alexander Wang and Joseph Altuzarra tempted us with throw-on-and-go ponchos and lush fur accents (when we imitate these trends, we’ll be sticking to faux fur). If you still have a poncho in your closet from when they were trendy in 2004 and 2005, bust it out now. You will have been ahead of the trend once they arrive in stores later this summer. Adding faux fur accents to your spring looks in the form of jackets with faux fur collars and hair accessories with faux fur poms is a great way to wear this trend when the weather warms up. Right now, you can save at end-of-season sales at places like ModCloth and then hold onto your purchases to wear when it gets colder this fall.
4. Sophisticated Polka Dots at Marc Jacobs
It looks like Marc Jacobs might be a closet fan of Minnie Mouse, because this season at Marc Jacobs, it’s all about polka dots (see top photo)! We noticed polka dot tights, skirt suits, berets, bag, dresses, shoes, vests, and more! The key to wearing this ultra-fun and feminine pattern right now is choosing big bold prints. For skirts and blouses, look for polka dot patterns where the dots are larger than a quarter. Scoop up black tights with any size polka dots, from tiny to quarter size. Stay away from colored polka dot tights, as anything besides black can look too clown-like and costume-y. If you’re bold enough to try wearing polka dot from head to toe, as seen on the runway, stick to a neutral palette to keep the look sophisticated. Try layering a polka dot blouse under a cashmere shell, tucked into a skirt, or for a more edgy look, paired with black jeans and boots.

5. Daring Mixed Fabrics at Preen
Preen’s show was all about wearing clothes made of different fabrics, sometimes so different that they didn’t seem to go together at all. If you’re one for taking risks in the name of high fashion, this trend is for you! One easy way to try the mixed fabric trend is to look for a cardigan with sequins on it. Another way to wear mixed fabrics is by pairing a heavily textured linen or cotton skirt with a flowing, satiny blouse.
The Shaded Glory skirt from Anthropologie ($88, above) could go with any breezy blouse.
This Emerson Made blouse ($148, above) would go well with a heavily textured skirt. Chances are you have a chambray shirt in your closet from when they were super popular last spring. Try wearing your chambray shirt tucked into a leather or suede skirt to pull off this trend.
6. Vibrant Color Blocking at Preen, DKNY, and Derek Lam
Color blocking happens when you wear two solid (usually bright) colors next to each other. To try this technique, layer bold pieces from your closet. Try wearing a white shirt, black blazer and solid skirt together to create blocks of color with your outfit. If you’re open to daring color combinations, try red with black, blue with black, and purple with blue (as seen at Preen). Or take a cue from DKNY’s show and pair pink with orange. Finish off your look with black tights and black pumps to keep it chic.

7. Cool Crop tops at Vena Cava
We hope you’re fans of early ‘90s fashion, because that’s exactly where Vena Cava pulled inspiration for their show this season. The hot item on the runway was crop tops. Yup—those belly-bearing shirts that hit just above high-waisted skirts and pants. This trend might be one best suited for the catwalk, or for your photo album containing pictures from 15 years ago, but if you’re brave enough to try this trend at home, visit Forever21, American Apparel, and Victoria's Secret’s clothing catalog to find crop tops, or go DIY with this trend and do like Cher did in the 1995 movie Clueless and take scissors to any old tee.
