Ruling Hurts Recovery of Madoff Funds

A federal judge's ruling has vastly undercut the power of a court-appointed trustee to recover billions of dollars for victims of Bernard Madoff.

The decision on Tuesday by U.S. District Court Judge Jed Rakoff in Manhattan directly applies only to a lawsuit filed by trustee Irving Picard against the owners of the New York Mets baseball team.

But lawyers familiar with the litigation said Wednesday that it curtails the scope of overall funds Mr. Picard can legally seize in the historic Ponzi scheme.

"He's going to get a lot less money," said Helen Davis Chaitman, a lawyer representing former Madoff customers being sued by Mr. Picard and a frequent critic of the trustee.

The latest development is the biggest legal blow in the three-year effort by Mr. Picard, who has helped recover more than $10 billion for Madoff victims so far.

A Curveball in Mets-Madoff Case

The legal theory behind the ruling could reverberate across more than 1,000 ongoing lawsuits through which Mr. Picard is attempting to recoup tens of billions of dollars in profit and principal withdrawn by investors before Mr. Madoff's scheme collapsed in 2008, the lawyers say.

It isn't clear exactly how much money the ruling will ultimately affect, with Mr. Picard and lawyers connected to the Madoff lawsuits still digesting the opinion and its impact.

But David Sheehan, a lawyer for Mr. Picard, said at a court hearing related to the Mets case on Wednesday that up to $6 billion—or more than a third of the principal the trustee says was lost in Mr. Madoff's fraud—could be off limits if the ruling is upheld.

Judge Rakoff slashed the amount of money the trustee can pursue in the Mets case from the $1 billion he was seeking to $386 million. The thrust of Judge Rakoff's decision stems from what some judges have called a policy conflict between U.S. bankruptcy law and securities law as to when investors should have to give back money they previously received.

Among its most significant provisions, Judge Rakoff's ruling shortened the period during which Mr. Picard can attempt to recover investors' withdrawal of false profits or principal from six years prior to the bankruptcy of Mr. Madoff's firm—the limit under New York law—to a two-year window allowed under federal law. Mr. Sheehan told reporters after the court hearing on Wednesday that Judge Rakoff's decision "eviscerated" their New York law claims.

That means the pot of money Mr. Picard could ultimately recover would be significantly smaller, and the money individual investors ultimately receive could be smaller still. The trustee has sued people and institutions who invested and allegedly profited off Mr. Madoff's Ponzi scheme, often unwittingly, in order to collect money he can use to repay other investors who lost some or all of the principal they sent to his firm.

A spokeswoman for Mr. Picard said it would be inappropriate for him to comment because of the ongoing litigation.

"If this opinion stands, it substantially reduces the magnitude of clawback recovery the trustee may be able to realize," said Richard Levy, a lawyer who is representing investors in other lawsuits filed by Mr. Picard.

"This is the beginning," said Ms. Chaitman, adding that she hoped for more favorable rulings ahead. Still, up to now, Madoff investors have felt optimistic about recouping more than half their principal investment through the trustee, and it's not clear this ruling would affect the proportion of those recoveries.

Howard Siegel, who invested through a fund with Mr. Madoff, said it wouldn't be fair if the decision reduces the potential recovery and allows the Mets owners, or any other Madoff clients who took out more money than they invested, to keep money at the expense of "net losers," who didn't take profits. "That to me would be outrageous that through the passage of time they get the right to keep other people's money," Mr. Siegel said.

Among those who could benefit are Mr. Madoff's brother, son and niece, who are battling a lawsuit in which Mr. Picard would have to drop claims for millions of dollars if Judge Rakoff's ruling is applied.

The ruling doesn't directly or immediately apply to other cases, but lawyers say it would have to be reconciled with several conflicting rulings by other judges. The decision by Judge Rakoff, who is presiding over a number of other Madoff-related lawsuits, could ultimately be evaluated by the U.S. Second Circuit Court of Appeals, thus far the highest court to rule on any Madoff matter.

Mr. Sheehan, the trustee's lawyer, said in court on Wednesday that Mr. Picard will seek permission for Judge Rakoff's decision to be reviewed by the Second Circuit.

In recent months, Mr. Picard has suffered a string of legal setbacks as district court judges—predominantly Judge Rakoff—have accepted requests by those sued by Mr. Picard to move cases out of bankruptcy court, a friendlier setting for the trustee.

Some lawyers said Judge Rakoff's ruling could force Mr. Picard to re-evaluate all claims for losses and how he distributes money he has collected, a process he was about to begin, to attempt to ensure that Madoff investors aren't being treated unevenly based on how much they withdrew and when. Mr. Sheehan said on Wednesday that a scheduled distribution of money to Madoff victims on Friday would be delayed in light of Tuesday's decision.

In recent months, judges had begun to express skepticism about the broad and aggressive claims filed by Mr. Picard. The trustee has sued individuals and institutions for nearly $100 billion, including fees and damages, in hopes of recovering as much as possible. He is likely to have a harder time reaching the types of settlements, on favorable terms, that fueled his initial success, including the $7.2 billion settlement reached with the estate of Jeffry Picower, a Madoff associate, in December, lawyers say.

In one example of the possible effect, Mr. Picard was seeking $5.8 million in allegedly false profits he said was withdrawn over six years from an account owned by Judith Rechler, a member of a family of real-estate developers in Long Island, New York. But only $625,000 was withdrawn in the past two years, reducing the amount Mr. Picard might recover under Judge Rakoff's ruling by about $5.2 million in profits Ms. Rechler allegedly received for trades that never occurred. Ms. Chaitman, her lawyer, declined to comment on the case.

In another major defeat for Mr. Picard, Judge Rakoff also struck from the lawsuit filed against the Mets owners the trustee's attempt to "claw back" money withdrawn within 90 days of Mr. Madoff's bankruptcy. Mr. Picard has tried to recover those withdrawals under a legal theory that says money leaving a Ponzi scheme shortly before it ends should be returned for the benefit of all investors.

Unless he succeeds in obtaining those funds under a different legal theory, that section of the ruling could impair Mr. Picard's ability to recover hundreds of millions, if not billions, of dollars, from hedge funds and banks that fed money to Mr. Madoff and tried to get their money out as the financial crisis ramped up in late 2008. "The biggest impact is going to be on the hedge funds," said Ms. Chaitman. "The individual investors are chicken feed compared to that."

Other questions lawyers involved in the Madoff lawsuits were exploring related to whether Mr. Picard might have to reopen claims he had denied from some Madoff investors he has called "net winners" because they withdrew more money from the Ponzi scheme than they originally invested. Judge Rakoff's decision said federal law doesn't permit Mr. Picard to "disallow" any claims, although lawyers differed about what that might mean. If he were forced to reopen claims he had denied, that could alter the calculation of how much money is eventually distributed to all investors.

Abstract: Type 2 diabetes mellitus and obesity share a pathogenic relationship, and both have rapidly increased in prevalence over the past decade. This review evaluates the effects of antidiabetes therapies on weight and glycemic control in the type 2 diabetes mellitus population. A PubMed search was conducted to identify randomized controlled trials that reported the weight effects of antidiabetes treatments. The search focused on the newer incretin-based therapies, including dipeptidyl peptidase-4 (DPP-4) inhibitors and glucagon-like peptide-1 (GLP-1) agonists. Antiobesity drugs and treatment options potentially available to patients with type 2 diabetes mellitus, including bariatric surgery, were also examined. Most of the established antidiabetes therapies (eg, sulfonylureas, thiazolidinediones) promote weight gain, thereby exacerbating insulin resistance and glucose intolerance. Dipeptidyl peptidase-4 inhibitors exhibit a weight-neutral profile, however, and GLP-1 receptor agonists (eg, exenatide, liraglutide) have achieved significant body weight reductions in spite of improved glycemic control, which is often accompanied by weight gain. Antiobesity drugs, such as orlistat and sibutramine, are effective weight-lowering agents in patients with type 2 diabetes mellitus, but safety and tolerability concerns may limit their use. Bariatric surgery in obese patients is associated with improved glycemic values and decreased mortality. Clinical evidence substantiating the weight-neutral effects of DPP-4 inhibitors and the weight-loss effects of GLP-1 agonists is promising, offering an expansion of therapeutic options for overweight and obese patients with type 2 diabetes mellitus. Evidence on the clinical utility of antiobesity drugs is more equivocal, and more data are needed to evaluate the safety and tolerability of these agents.

The"Electronic Flight Bag Manual" is a compilation of AC 91-78: Use of Class 1 or Class 2 Electronic Flight Bag (EFB), AC 120-76A: Guidelines for the Certification, Airworthiness, and operational approval of Electronic Flight Bag Computing Devices, and selected FARs. A review of this material will give a pilot a great overview of the federal documents covering EFBs.

AC 91-78 provides aircraft owners, operators, and pilots operating aircraft under Title 14 of the Code of Federal Regulations (14 CFR) part 91, with information for removal of paper aeronautical charts and other documentation from the cockpit through the use of either portable or installed cockpit displays (electronic flight bags (EFB)).

AC 120-76A provides an acceptable method of compliance for the certification, airworthiness, and the operational approval of both portable and installed Electronic Flight Bag (EFB) aircraft computing devices. This AC does not constitute a regulation but sets forth an acceptable means, but not the only means, for operators conducting flight operations under Title 14 of the Code of Federal Regulations (14 CFR) part 91, 121, 125, 129, or 135, to obtain both certification and approval for the operational use of EFBs. This guidance material also applies to operators of large and turbine-powered multi-engine aircraft operating under 14 CFR part 91, subpart F where the operating regulations require specific functionality and/or equipage. Other part 91 operations do not require any specific authorization for EFB operations provided the EFB does not replace any system or equipment required by the regulations.

Most readers are aware of sun signs and the significance of zodiacal constellations, yet the importance of fixed stars, especially those outside the ecliptic (the plane through which the planets travel), is often overlooked in contemporary astrology. Brady has returned to the art's origins, reviving the ancient meanings ascribed to individual stars in both the northern and southern hemispheres. Fixed stars add their own influences to a person's horoscope (sometimes subtly, sometimes with drastic changes) through "paran" relationships with the planets. A star and planet are paran when they simultaneously occupy certain positions in the sky. Brady has accomplished the daunting task of charting the rising, culmination, and setting of 176 stars. She has researched their mythology in several cultures, and offers an interpretation of how each of the stars can affect a horoscope. While figuring paran relationships can be done with good computer software, such programs do not offer the rich history and revealing interpretations found in Brady's Book of Fixed Stars, and there is also something to be said for consulting charts and the nostalgia of old-fashioned, hands-on astrology. --Brian Patterson

Born in 1876 to a wealthy American family from Ohio with connections to the arts her grandfather built the second opera house in New York City Barney began her public life at the age of six when she met Oscar Wilde. After coming out as a lesbian in the U.S. (at 17, she had her first love affair with 20-year-old Evalina Palmer), Barney moved to Paris in 1899 and began a very public affair with Lilane de Pougy, celebrated courtesan and author of romantic potboilers. By 1903, Barney boasted of having "the most respectable of bad reputations"; no less then three literary works (including a novel by Colette) featured thinly veiled portraits of her as a notorious lesbian. Notoriety begot legend as Barney, having formed deep friendships with Gide, Pierre Louys, Paul Claudel, Remy Gourmont and other literary stars, became one of the most famous salonists in Paris as well as a noted poet and novelist who published 21 books. By the time of her death in 1972, Barney was a literary and social institution. Rodriguez (Found Meals of the Lost Generation) has done a superb job assembling the historical details (she traces Barney's ancestry back to the mid-1700s) and in fleshing out Parisian literary history (such as Barney's intense rivalry with Gertrude Stein and Alice B. Toklas). She deals with the romantic complications of Barney's life, especially a long affair with painter Romaine Brooks, with grace, and delineates the contradictions in Barney's life, such as espousing a glib anti-Semitism even as she was being harassed by the Nazis because of her Jewish heritage. This bio, the first of Barney in English in more than 20 years, should resurrect deserved interest in a major 20th-century literary player.

This book is the best of its kind—a serious, deeply felt reflection on the weight of history on contemporary affairs. Weiner, a historian/attorney at Rutgers School of Law, examines how court proceedings involving black people—and whites trying to assist them—have served as windows onto race relations and the power of whites over blacks in the U.S. from its earliest days. Using specific cases (such as those of the Amistad, the Scottsboro Boys, Black Panther Huey Newton and Mumia Abu-Jamal), he charts changes in Americans' civic inclusiveness—i.e., "what it means to be an American," and whether it includes blacks—and the long struggle for civic inclusiveness in the U.S., a struggle not yet over. The law, in Weiner's view, affects, as much as it reflects, the larger culture; while the law adjusts the rules that govern individuals' behavior, it's also a litmus test of the power of jurisprudence to improve the lot of the least powerful. His worries about the ability of a liberal definition of civic participation to sustain itself without an anchor in religious faith are worth considering. Weiner's history reveals, as he acknowledges, decent progress in American race and ethnic relations over the decades. But, as he also recognizes, there's always more to be done.

Adult/High School--"Wanted: Young, skinny, wiry fellows, not over eighteen. Must be expert riders, willing to risk death daily. Orphans preferred. Wages--$25 per week." Thus ran a notice in several western newspapers in 1860. Or maybe not. This is just one of many unproved "facts" about the Central Overland California & Pike's Peak Express Company, better known as the Pony Express. The Pony's day was short, a mere 18 months, from April 3, 1860, to October 26, 1861 (just two days after the completion of the first coast-to-coast telegraph line). The company was a financial disaster for its owners. The total amount of mail carried was insignificant. Ah, but the "twisted truth and lasting legend," now that is something a good writer can throw in his saddlebag and ride with. And Corbett does exactly that in this fine analysis of the famed riders of the Wild West. He does an excellent job of finding bits of truth hidden behind layers of myth. For example, Buffalo Bill Cody and Wild Bill Hickok were not Pony Express heroes, despite numerous dime novels and Hollywood westerns to the contrary. On the other hand, true heroes were lost among the lore. The feats of Robert Haslam and William F. Fisher were impressive by any standard. This book tells two main stories: what happened (so far as is known) and how the legend grew (about which much is known). A good selection for Old West aficionados, especially those who relish the challenge of separating fact from fiction.--Robert Saunderson, Berkeley Public Library, CA
